Florida Makes It Into The Top 10 For America’s Worst Drivers

GMAC Insurance recently conducted a survey of a driver’s basic knowledge of the laws of the road. The company quizzed more than 5,000 drivers in all 50 states and the results are in. While New York has what GMAC Insurance deems as the worst drivers, Florida finished ninth overall. Many law firm clients think that the lack of knowledge of traffic laws is a valid defense against their Florida traffic ticket but unfortunately that is not the case.

According to the survey about 41 million Americans would fail their written driver’s test if they had to take it today. While most drivers are aware of the laws surrounding speeding, running a red light and driving with a suspended license there are many laws out there that Florida driver’s aren’t as familiar with. Some are newer laws like Florida’s Move Over Law or some are just misunderstood like what is careless driving or reckless driving. If you want to take the test yourself, visit www.nationaldriverstest.com. See how you fare!

After 1,100 Tickets For Running Red Lights, Hillsborough’s Red Light Cameras Still A Hot Topic

In just over a month, the red light cameras in Hillsborough County have been responsible for 1,100 citations for running red lights. Those citations have meant over $100,000 to the city’s coffers. As the money rolls in the debate continues on as to whether the cameras make Tampa’s streets safer or just make money.

Cpl. Darrin Barlow told My Fox Tampa Bay’s April Kellogg that the people who run red lights are endangering motorists but some of those very motorists disagree. Kellogg spoke to Tampa citizens who have witnessed increased danger on the roads due to the way people drive because of the red light cameras. That was a major concern for many when the cameras were first being discussed.

Florida Cop Facing Felony Charges For Writing Unwarranted Traffic Tickets And Making Illegal Traffic Stops

A 21-year veteran of the Melbourne, Florida Police Department is facing five felony charges of official misconduct and four misdemeanor charges for falsifying records according to a story on Florida Today and FDLE reports. Officer Frank Carter is accused of writing unwarranted traffic tickets due to video that was reviewed from his in-car dashboard camera. Carter’s attorney claims the traffic stops were warranted due to drug dealing in some Melbourne neighborhoods.

Some of the traffic citations handed out by Carter that FDLE flagged were for driving without headlights when they were not required or no tag lights when the car’s tag lights were working. Some residents in south Melbourne claim that Carter has been a “thorn in the side” to the town’s African-American population for years. Carter was released from the Brevard County Detention Center on a $2000 bond.

Red Light Runners Ticketed By Cameras May Get Their Money Back If Florida Lawsuit Prevails

Another lawsuit has been filed against Florida’s red light camera system. A Lakeland, Florida lawyer has filed a lawsuit against the city of Lakeland and the company that operates the cameras that target people who run red lights. This lawsuit, the third against red light camera operators in the state of Florida, claims the company that runs the cameras does not have the proper state licensing. Since the cameras went into operation in Lakeland, the city has collected more than $1 million in fines and issued traffic citations totaling more than $2 million.

The lawsuit is asking that there be a repayment of the traffic citation fines at up to four times the amount of the ticket, according to a story by the Lakeland Ledger. The city is in the midst of a three-year contract with American Traffic Solutions who operate the red light cameras. This current lawsuit does differ from the first two in that this one claims ATS has not received the proper private investigating license required in Florida.

Red Light Camera Tickets Proving Tough Case To Beat In Florida

There is a reason red light cameras are showing up all over the state of Florida and you just need to look at Brooksville to see why. Since March, the city has collected nearly $300,000 in fines from red light runners. Not only is the city making money the accused offenders are finding it very hard to even challenge these traffic citations. There is no judge in these cases since they are civil infractions so the city hand picks a special hearing officer who decides if the red light runner has a case. Usually the answer is no they don’t.

Brooksville had a special master residing over these tickets but he felt the city ordinance was being enforced unfairly. So what did the City Council do? They found someone who had a point of view more in line with the city's and now very few of these fines are being overturned. That has left some Brooksville residents angry according to a story on TampaBay.com and even drove one man to join a class-action lawsuit fighting Florida’s red light cameras.

MANATEE TRAFFIC BLOG: 59 Driver’s Cited With Traffic Tickets For Passing Stopped School Buses

The Manatee County Sheriff’s Office Traffic Unit took National School Bus Safety Week to heart. The sheriffs wrote traffic citations to 59 drivers who failed to stop for school buses letting off passengers. Many of the traffic offenders didn’t even know they had broken the law according to the story on the Bradenton Herald’s website.

Part of the confusion for drivers is not being aware of what the law is when it comes to school buses. Most drivers know they must stop when they are on the same side of a street as a school bus. Many are being ticketed though for not stopping on the opposite side of the road. Motorists are required to stop going the opposite way if there isn’t a raised median, unpaved section of at least five feet or some other form of barrier. The ticket for this infraction is over $270.00.

FLORIDA TRAFFIC BLOG: Looking At The Year 2008 In Traffic Tickets

According to a column in the Tallahassee Democrat, there were 5.21 million traffic citations in Florida in 2008. That is a small 1% decrease from the year before and bucked a trend that saw the number of citations increase every year starting in 2004. The reason for the decrease according to the author is that Floridians are driving less.

There is one area that did show a large increase and that concerned Driving Under the Influence. From 2007 to 2008 there was a 9% increase in DUI convictions in the state of Florida. Half of all citations written in 2008 were issued by city cops, a quarter by county sheriffs and a fifth by the FHP. Overall tickets may have been down but the number of cops is up as there were more full-time officers on the job statewide in 2007 than in 2008.

Paikai attempted to execute a routine traffic stop after Robert Swank ran a red light in Avon Park. The officer was most likely just planning on writing a traffic ticket to the Florida driver but that’s when things took a deadly turn according to an Associated Press story on the Bradenton Herald Tribune website.

After Paikai pulled Swank over he exited his cruiser and began to approach Swank’s car. At that point the 37-year-old struck the officer with his car. In order to stop the assault Paikai fired his weapon and shot and killed the car’s passenger, 33-year-old Amber Gregory. Paikai was taken to the hospital and an investigation is under way.

FLORIDA TRAFFIC BLOG: Can A monkey Receive A Speeding Ticket?

A man in Phoenix, Arizona has received 37 speeding tickets issued in photo radar zones that total $6,700. The problem, the guy in all 37 photos is wearing a monkey mask or a gazelle or even a giraffe. David VonTesmar has been accused of being the speedy driver but he issued a Facebook rebuttal to the accusations saying he has seen no proof that the driver of the car is actually him even though he admitted to owning the monkey mask according to a report by ABC News 15.

VonTesmar said the masks are in his car but family, friends and co-workers have access to the car as well and he will never admit to being the monkey-masked driver seen on video speeding through traps. The Arizona Department of Public Safety has said the masked driver is a danger to other drivers but VonTesmar, who admitted he believes in peaceful, civil disobedience, would never endanger the lives of others or himself, whom he admits to being very fond of.

FLORIDA TRAFFIC BLOG: Florida Leading The Way Among State That Are Cracking Down On Aggressive Driving

Those of us who live in Florida are aware of all the new laws and regulations that are being instituted to crack down on aggressive drivers but apparently the whole country knows about it now thanks to a recent article in USA Today. The article talks about the new Florida law that will go into effect on January 1 that sends a driver found to be at fault in three traffic accidents in a three year period back to school for a strict driver education test that also requires a road test.

That law is joined on the books by another that will go into effect in less than a month. That law makes traffic school mandatory for first-time offenders of certain moving violations. That used to be an option for drivers but not a requirement. The new laws are said to be aimed at people who are aggressive drivers, which in the state’s eyes are those who speed, tailgate, change lanes without indicating, weave in and out of traffic and ignore traffic signals. According to reports, this type of behavior on the road causes more fatalities than drunk driving.

TAMPA TRAFFIC BLOG: FHP Steps Up Enforcement Of A Law Not A Lot Of People Are Aware Of

As you drive to work this morning you better beware of the “Move Over” law that was passed in 2002. The law states that drivers must change lanes away an emergency situation when approaching a patrol car, emergency vehicle or even a tow truck. If you are unable to change lanes you must slow down to 20 MPH according to the law. Up until this point the Florida Highway Patrol has lightly enforced the law. That has all changed as of this past weekend. (read more)

The law was passed to protect officers and other emergency workers from being struck by cars traveling at high rates of speed on highways. The crackdown will run through September 7 and if you are ticketed you will receive a $166 fine and three points on your license. FLORIDA TRAFFIC BLOG: 78-Year-Old Grandma Arrested And Jailed For Unpaid Parking Ticket

Mary Anne Mann, 78, and her 11-year-old-dog Sadie found themselves in trouble earlier this week due to an unpaid parking ticket from November of 2008. When Pasco Sheriff’s deputy William Peace, Jr. pulled over Mann’s white Cadillac he thought he had caught an impaired driver. He recognized the driver from when she reported the same Cadillac as stolen in June of 2008. Turns out the car was dropped off for an oil change and left at the shop for two weeks. (read more)

Peace ran the grandmother’s license after he pulled her over for driving 20 miles per hour under the speed limit and found there was a warrant out for her arrest due to that unpaid parking ticket. Mann was arrested, without the use of handcuffs, and her dog taken in by a fellow deputy to avoid calling Animal Control. Mann spent 5 ½ hours in the Land O’Lakes jail.

SARASOTA TICKET BLOG: Cop In Sombrero Not Just Standing On Street Corner For The Fun Of It

The new seat belt law in the State of Florida got off to a bang on July 1 with the Hillsborough County Sherriff’s department writing over 200 tickets on the first day alone. Since then there hasn’t been many headlines written about F.S.S. 316.614 but today the drivers in downtown Sarasota got a reminder about the new law on Friday.

As SRQ residents pulled up to the stop light at Fruitville and 301 they saw a nice man in a sombrero (see photo) holding a sign. The cardboard sign said “Read F.S.S. 316.614. Tickets on sale $99.00”. As drivers looked on and honked at the man, actually a Sarasota police officer, they didn’t know what was lurking just a few hundred feet away. The sign was really just used to cover up the walkie talkie clipped to his collar letting a second officer on the next block know which cars to pull over due to a seat belt violation. As of 11:00 a.m. the pair were still hard at work.

FLORIDA TRAFFIC BLOG: Red Light Cameras Ticketing For More Than Speeding Through A Light

In a couple weeks Bradenton drivers will be under the watchful eye of red light cameras. A similar company that installed the cameras in Bradenton is operating red light cameras in another Florida town and in just one month, they city is raking in fine money. According to Bay News 9 4,400 citations have been issued and one Lakeland woman has already accumulated more than $1000 in fines.

If you think the red light cameras won’t affect you because you will stop on yellow rather than gun it through a red, you need to be aware of another thing these cameras can catch. According to Lakeland police a majority of the red light camera tickets are for drivers rolling past the white line before making a right turn on a red. That was the case for Kristen Kent who received seven tickets at the same intersection for the same violation and now owes more than $1000.

Police contend this driving behavior is just as dangerous as speeding through a red light because a pedestrian could be in that crosswalk when a driver makes that right on a red without stopping. Kent says it is hard to argue with the photographic proof of her violations but argued she wouldn’t have been charged with the offense seven times if an officer had stopped her initially and let her know what she was doing was a violation.

If you have a traffic ticket in Bradenton, Sarasota or Manatee due to the red light cameras or any other offense, please do not hesitate to contact Sarasota Traffic Attorney David Haenel at 1-800-FIGHT-IT to discuss the matter or visit our website at fightyourtickets.com. PINELLAS COUNTY TRAFFIC BLOG: Reckless Driving Traffic Stop Leads To Death Threats Against Pinellas Sheriff Deputies

What seemed like a routine traffic stop at 1:36 a.m. in Pinellas County turned into anything but that according to sheriff’s deputies. The police allege that Jose Miguel Rodriguez-Irizarry sped past four sheriff’s deputies at 63 MPH in a 35 MPH on Main Street in St. Pete. When deputies tried to pull Rodriguez-Irizarry over he sped up to 80 MPH in a 45 MPH speed zone. When deputies finally made the traffic stop, things got strange. (read more)

TAMPA TICKET BLOG: Florida Highway Patrol Trooper Claims He Was Fired For Writing Too Few Traffic Tickets

Former Florida Highway Patrol trooper Chris Maul is claiming to Tampa’s Bay News 9 that he was fired from his job with the FHP due to the fact that he did not write enough traffic tickets. Maul, who patrols the Tampa area, was on a probationary period with the FHP after a six-month leave. Prior to the six-month leave, Maul was on the job for 12 years. (read more)

In May Maul made four DUI arrests and 40 other arrests. His direct supervisor wrote to Maul to “keep up the good work” in his quarterly evaluation. Shortly after that evaluation Maul spoke to an FHP captain and according to the 44-year-old trooper he was told that his “activity was not going to cut it if he wanted to get off probation”. He was terminated in June.

Tampa And St. Petersburg Officials Fight With Florida’s Clerk Of Courts Over Rising Revenue From Traffic Fines

A rise in fines for traffic violations is somehow netting Florida cities less money at least that is the claim in Tampa and St. Petersburg. The reason is that a new law is allowing the state’s clerk of courts to withhold a larger portion of the increased fines and fees for their own use. (read more)

With budget cuts and shrinking state dollars available to cities all across the state, there is a real possibility that Florida’s cities could end up suing Florida’s clerks of the court in challenging this new law that went into effect July 1. The loss in revenue under the new law is significant. In St. Pete alone the city received almost $682,000 in ticket revenue last year. The city estimates there will be a six-figure drop in that revenue this fiscal year.

Is A City Outside Orlando Installing Red Light Cameras Just To Make A Buck On Traffic Tickets?

A debate is raging in a small town outside of Orlando. Groveland, Florida is installing cameras on all the traffic lights in town to catch drivers who run red lights. The problem? There are only five red lights in the whole town and residents are protesting the move as simply a way to generate revenue by writing more traffic tickets. (READ MORE)

American Traffic Solutions would install the free cameras and give the city 70% of the revenue that is raised. Mayor Richard Smith was quoted as saying the company claimed the city could raise six-figures at each intersection where a camera is installed. The mayor was also quoted as saying that the money raised from the cameras could help prevent layoffs and make the streets safer at the same time. The City of Orlando, which also uses cameras at intersections, said it raised $500,000.00 in an eight-month span using the cameras.

Lawyer Serving Tampa, Sarasota And Orlando Featured In AOL Story On Speeding Tickets

Respected traffic lawyer David Haenel lent his expertise to an AOL Auto article released July 2nd concerning Florida’s use of aviation law enforcement to monitor speeders, reckless drivers and soon-to-be felons fleeing a police pursuit. The article, written by Craig Howie, relies on Haenel’s experience in the area to provide insight on how lawyers challenge speeding tickets that are based on aircrafts timing drivers through a zone.

Haenel is a defense lawyer based in Sarasota who handles traffic tickets statewide. He was the DUI Prosecutor of the Year in 2004 and has gotten to know many of the FHP pilots through his years as a lawyer. Tampa Drivers Receive More Than 200 Tickets From Hillsborough County Sheriffs Under New Seat Belt Law

The first day under Florida's new seat belt law was a boon for the state coffers and a pain for Tampa drivers. The St. Pete Times is reporting Hillsborough County Sheriffs wrote more than 200 tickets to drivers under the new Florida Seat Belt Law that just went into effect Tuesday. (read more) Tuesday’s crackdown was part of Hillsborough County's Operation Belts or El$e. Notice the “s” was replaced with a dollar sign as the tickets range from $90-100 bringing in roughly $20,000 on the first day alone.

Deputies began writing tickets at 7:00 a.m. at State Road 60 and Parsons Avenue in Brandon. In approximately two hours they wrote 86 tickets. They also arrested a woman on charges of driving with a suspended license and giving a false name to deputies. The state fine for the violation is $30 but each county is allowed to tack on court costs or other fees. In Hillsborough and Pinellas, a ticket costs drivers $101. In Pasco and Hernando, the cost is $99.

An early morning police chase resulted in the arrest of 28-year old Albert Jarell Thompson Jr. Tuesday. Florida’s New Seat Belt Laws Go Into Effect On Tuesday

Starting Tuesday Florida law enforcement officers can pull cars over and issue traffic tickets if the driver of the car or the front-seat passenger is not wearing a seat belt and according to state troopers they are planning strict enforcement of the new law. FHP said troopers will write a $30 ticket for anyone not wearing their seat belt. Florida is now the 28th state to have a primary seat belt law. (read more)

While law enforcement is cheering the change as a way to keep Florida drivers safe, the ACLU is opposed to the law. The ACLU feels the best way to get people to wear seat belts is not to make it a crime and bring law enforcement into the process but when Florida Governor Charlie Crist signed the law on May 6 the ACLU’s battle to keep the potential law off the books died. The National Highway Traffic Safety Administration applauded Crist’s decision to sign the law saying it will save 100 lives per year in Florida.

Teen Driver In Tampa Offered A Deal By Cop In Fatal Hit-And-Run In Hyde Park

Teenager Jordan Vasquez recently gave a statement to the State Attorney’s Office about a fatal hit-and-run crash in which she claims the officer made her an offer and an internal Tampa Police Department document says “they are awaiting a response”. (read more). Nobody involved is speaking to the media about the situation involving the death of Melissa Sjostrom who was struck and killed by a vehicle walking across South Hyde Park Avenue near Azeele Street.

Tampa Police have been searching for evidence to implicate Vasquez in the hit-and-run and have searched her home and seized computers and phones hoping to uncover evidence against the teen who was 16 at the time of the accident. The teen has only been issued a citation for civil careless-driving but that was dismissed when the detective who issued the citation failed to show up in court to testify.

Tickets From Sunpass Toll Violations Are Clogging Courts In Miami

We all love being able to bypass long lines of cars waiting to pay tolls thanks to Sunpass…well maybe not all of us. The courts in Miami Dade County are now being overrun with Sunpass toll violations due to a little-noticed tweak in the state law that now requires violators to appear in court if they want to avoid costly points against their driving record (read more). In Miami Dade County nearly 30% of all traffic citations last year were related to Sunpass toll violations. With the popularity of the program, things are only expected to get worse in the future.

Toll violations never used to require seeing a judge until recently. Violators just had to go to the clerk's office and pay the ticket. During the 2007 legislative session, tucked inside a 142-page transportation bill, lawmakers deleted the provision allowing clerks to withhold adjudication. To avoid three points, scofflaws now have to attend court to make their case to a judge. Combine that with more efficient ticketing processing and Sunpass toll violations have become a major part of the daily business in traffic courts around the state.

If you or a loved one has a Sunpass toll violation or any traffic ticket that you need help with, please contact David Haenel at 1-800-FIGHT-IT or online at www.fightyourcase.com.

Speeding Ticket Numbers Jump in Sumter and Lake County, Florida

According to an article by Matt Dixon of the Daily Sun, Speeding Tickets Spike in Sumter, Lake Counties the number of speeding tickets issued in Sumter and Lake Counties has increased an incredible 391 percent since 2003. In these tough economic times, law enforcement is helping to fund the budget deficit faced by the Courts statewide. A recent change to the funding scheme developed by the Legislature ended the 18 percent reduction that motorists received when they elected traffic school. That additional funding has been shifted to the Judicial branch to fund the courts and prevent state furloughs. With the increase in citation money, the clerk's office in Lake County has been able to enjoy "posh" seminars, as well as additional money for their bank account. A large percentage of money from speeding tickets ends up in the general revenue fund. The Sheriffs Office attributes the rise in speeding tickets to an increase in enforcement, including the creation of a new traffic unit. In addition, the Lake County is not alone in its increase in the use of unmarked cars. The Florida Highway Patrol continues to use unmarked Dodge Chargers in its attempt to combat speeders and aggressive drivers. If you have received a speeding ticket in Lake or Sumter County, Florida call our office at 1-800-FIGHT-IT so we can discuss the particular facts of your case and try to determine any possible legal defenses.

Florida Highway Patrol Announces Traffic Blitz

The Florida Highway Patrol announced a statewide traffic enforcement detail referred to as "Operation Safe Ride". According to FHP Col. John Czernis, director of the Florida Highway Patrol, all available personnel will be out on the roadways on December 17-18 in an attempt to get motorists to slow down and drive safely during the holiday season. Florida has always had a very proactive traffic law enforcement community and statistics often claim that 15 percent of all traffic tickets issued in the country come from Florida. In the last year that statistics are available, the Florida Department of Highway Safety and Motor Vehicles reported that over 1.3 million speeding tickets were issued to motorists. That statistic only accounts for actual speeding citations and not for violation of a traffic control device which is a modifed speeding ticket in the State of Florida. An officer has discretion at the time of the traffic stop to issue a citation with reduced points and fine if the driver was cooperative. Because the cost of traffic tickets has increased so dramatically in the last few years many officers are using that statute and cutting motorists a break. The Florida Highway Patrol uses fix winged cessna airplanes, unmarked marauders and chargers, and slick top Ford Crown Victorias in combatting speeders and aggressive driving. The Florida Highway Patrol has always been understaffed as a result of Florida troopers being the lowest paid state police agency in the United States. Check out our website for Florida county specific information and details about the different types of criminal and traffic infractions.
